QUESTION: What is the most important thing to do when getting treatment from a medical provider following a car accident?

ANSWER: If you’ve been injured in a car accident, it is critical to follow your medical provider’s advice. Keeping your appointments, following through with referrals and doing the stretches and exercises from your providers is how you make a full and speedy recovery. It helps you get better quicker, and it helps your claim! Take care of your personal injury claim, by taking care of your injuries.

The third biggest mistake you can make is not following your medical provider’s advice after a car accident. We all know what’s most important when you’ve been injured is having a full recovery as quickly as possible. The way that’s going to happen is if you’re doing what your medical provider is asking you to do.

Make sure you are keeping all of your appointments. There’s always going to be exceptions, that’s perfectly understandable. Oftentimes, we see clients missing appointments consistently. Not only does that delay their recovery, when it comes time for us to settle their case, but we also hear the insurance company adjuster say, “Well if they were really injured, they would’ve consistently seen their medical provider”.

Another problem that we see is people not doing the exercises and stretches, or doing activities that their medical provider said they should not be doing. The truth is it’s sometimes hard to follow your medical providers advice. It is important to know that our clients who do the exercises and stretches that are given to them, are the ones that make the quickest recovery. Additionally, when clients finally start doing their exercises and stretches they say, “Oh my goodness, I wish I would have been doing this sooner because it’s been helping me so much.”

If your medical provider is telling you not to be weight lifting or not doing specific activities at work, it’s important to follow their advice. The information about how you’re doing if you are not following your medical provider’s care instructions is going to be in your treatment chart notes. When it’s time to settle your case, the insurance company is going to have a copy of your chart notes. If they see you’re not following your medical providers advice, they are going to offer you less to settle. The adjuster will say, “Well, since they didn’t follow their medical provider’s advice, it must not really have been a problem.” We know that’s not true but it looks that way.

When we are evaluating our clients claims, we’re not concerned about what the insurance company thinks. We care what a jury thinks. If you’re not following your medical provider’s instructions, a jury is going to think you must not really have been injured.

Follow your medical provider’s advice. You will never be sorry you did.

We’ll help you determine whether you have a case and if you need an attorney. It doesn’t make sense to hire a lawyer if you don’t need one.
